Drunk Driving and the Law

Maryland law provides for three levels of drunk driving offenses. Each carries progressively stiffer penalties:

• Driving While Impaired — driving with blood alcohol content (BAC) under .08%, or driving under the influence of drugs.
• Driving Under the Influence — driving with BAC between .08% and .10%.
• Driving While Intoxicated — driving with BAC of .10% or more

A conviction on any one of these charges depends on the results of the breath or blood test and additional observations made by the arresting officer. But the police make mistakes, and breath tests are not always accurate. Even if the results of your breath test fall within a range shown above, there may be successful defense strategies that can be used to reduce the charge or get it dismissed entirely.
